opened them up and closed them. let's look at tony perkins to see what today brings weather wise. >> good morning to you and everybody. this morning the rain showers are pushing out. the only areas where we're seeing shower are well off to the east. it is rather windy. let's look at your radar. this radar overplaying it a bit but the heaviest rain is now off the coast so that is good. going to still see rain showers move through portions of southern and eastern maryland. that is about it as it takes it's time to move out of here. current temperatures across the region, we continue to see temperatures fall. here in the district it's 50 degrees. look how old it is out to the west. 39 degrees in pittsburgh. 37 in columbus. 32 at the freezing mark in chicago. now here is a look at the wind speeds. winds blowing at 21 miles per hour in the district, gusting up to 28 miles per hour.

so a breezy start to the day. and clouds this morning but sunshine later on. breezy and much cooler. high only around 60-61 degrees today. that's a look at the weather. now here is an update on traffic from julie wright. if you're traveling the outer loop of the beltway you'll find lanes open leaving 95 toward georgia avenue. also on the outer loop, no problems to report living the springfield interchange in the direction of the wilson bridge. and slow leaving duke street on 395. lanes are are open out of germantown, falls road to the split. that's a check of your fox 5 on- time traffic. it has been a long and difficult night for rescue crews searching for survivors in the deadly mine blast in west virginia. >> conditions underground became too dangerous so crews had to back out, frustrating in

the rescue efforts. craig boswell joins us live from raleigh county. craig, good morning. >> reporter: as you mentioned, a double dose of disappointing news this morning. not only did they have to pull both teams out, but they also checked one of the two refuge chambers they wanted to check and there was no one inside. and they'll drill a hole and drop cameras down into the area where they think the other chamber is and try to see if there is someone else inside as a last ditch efforts. moments ago we heard from the governor and hear is what he had to say. >> one chamber has been checked. the chamber by the -- right here that has a visual. it was not deployed and it was in tact and not deployed so we know there was nobody in that

chamber. so we have that one more chamber left to check. >> when they broke the plain and went in the four connecting entries, we have smoke and the smoke is traveling from this side toward the long wall face indicating that we have a fire somewhere. >> reporter: and the thing is they don't know exactly where the fire is. that smoke was a complete surprise to them this morning. reason they had to pull the crews back out. again they are not sending the crews back in. what they have to do now is drill holes and try to stick a camera down in there. the microphone and listening equipment as a last ditch effort in the last place they believe the four missing miners may be. >> when we heard from the governor and kevin strickland 30 minutes ago and i know they've exhausted but you're starting to sense from them it seems like the frustration is really starting to set in at this point. are you picking up on that? >> reporter: certainly. and another thing you pick up

is that this has been a rescue operation from day one and now without saying so they are starting to indicate that it's quickly becoming a recovery operation. >> very disappointing. craig bosswell, thank you very much. they do still have a few hours left before any hour supply would run out and that would be running through this afternoon. and the hunt is on for a missing potomac man. 86-year-old william henrehan junior walked away from the national medical center in bethesda 4:00 p.m. yesterday and then spotted at georgia avenue entrance to the walter read medical center. he was last seen wearing an army hat and gray and bound suede jacket. we have more details this morning on a man who caused a scare in the skies. how his next flight now will be out of the country but he won't face any charges here for smoking in the plane's bathroom

and then making a joke about terrorism. this all happened on a flight from d.c. to denver. al mad audi was on his way to check on a terrorist. >> reporter: he is a junior diplomat at the qatary embassy in washington and accused of smoking a cigarette on a flight from reagan national to denver on wednesday night and joking that he tried to light his shoes on fire when caught by the flight crew. >> this is a very serious issue. any of us who travel are airlines are reminded of that every time we take off. >> but he is a diplomat and has diplomatic immunity and will not face charges for the incident witnessed by this woman. >> some man got mad and he was chuckling about it. >> and he was brought to a

hotel in denver where we were able to determine what had happened. >> reporter: the qatary embassy ordered him to go to the colorado prison to speak with a terrorist. he pled guilty last year to conspiring to support terrorism. diplomats often visit foreigns held in the united states to make sure they are being treated well. >> and our counselors do it and two americans incarcerated in other countries and it is something they do. >> reporter: qatar is along the persian gulf near saudi arabia. he was supposedly brought home on a united airlines flight from denver to dulles thursday afternoon but not among the passengers we greeted at

arrivals. the qatar ambassador said he will leave the country within hours and where he's going to isn't clear. either home to qatar or to another country to again serve as a diplomat. bob barnard, fox 5 news. it is 7 minutes past the hour right now on this friday afternoon. the qatar ambassador said he should leave the country today. anybody else who would pull this stunt would likely still be in jail so we'll take later this morning about diplomatic immunity and if this case sets any precedence for more disruption on flights. now to some of the other big stories we're following this friday. two former top executives of fannie mae face questions about the company's role in the housing boom and the eventual bust. this is the third day of hearings as the government tried to examine the cause of

the financial crisis. on thursday the panel scolded robert rubin at the citigroup company about how they handled things when he was a top executive there. and today mayor adrian fenty will deliver his fourth state of the district. this speech comes after three years of reforms resulting in stronger schools and safer streets. he'll deliver the address from the new dean wood rec center in northeast at 10:30 this morning. some are calling the g-45 a snuff by israel. but some streets will shut down. sherry joins us with the streets to avoid. >> reporter: good morning. remember the president's inauguration and what a nightmare everything was then. well this could actually be worse. we haven't seen this kind of security and road closures since then. but we do know this metro stop at the convention center will

be closed and roads will be shut down. you can see the barricades they have there ready to go. as for traffic, imagine a presidential motorcade and then multiply that by more than 40 other heads of state and that gives you an idea how bad the traffic might be. the summit follows the signing yesterday between a treaty between the u.s. and russian. the u.s. senate and russia's parliament must approve and next up is the g-45 nuclear summit here in d.c. the gathering of world leaders will bring security to city. late sunday evening the secret service will begin tightening security around the d.c. convention center where the summit will be. the mount vernon metro stop will close for the area. new york and massachusetts avenue around the convention center will be closed and everything from k. street to q

street and 7th to penn street. anything in the perimeter will be asked for identification and their bags checked. >> we pay attention to what goes on around the world and the last thing we need is to take anything for granted when it comes to security. so even on a daily basis we ask our officers to check credentials and verify people in uniforms or in service vehicles. it's just good security. >> reporter: now anyone near the perimeter who also looks suspicious will be stopped and asked for identification and possibly have their bags searched as well. all of the roads around here will remain closed until the very last of the dignitaries leaved on tuesday night so this will last for nearly three days. now unlike the inauguration when the city pretty much shut down, this is a normal work day for most of the washingtonians around here and that means things will be even worse. officials are urging federal workers to take some leave, work from home and do whatever

two astronauts from the discovery are doing their first of three space walks outside of

the international space station that will happen today. they'll remove a new ammonia tank and disconnect the old tank that provided the cooling system. this is the first time ever that four women are in orbit together. and i suspect they'll got a lot done, because that's how we women are, so efficient and multi tasking. the weather may have rained on the parade here, but for allergy sufferers are happy. >> pollen count exceptionally high. the second highest day they've seen in the past years. they used the device in silver spring spring to calculate the pollen count. >> we do the best we can. it's sort of years ago from an artform into a science and it gives us a good estimate per cubic meter of air.

story. winds out of the north at 15 miles per hour so a breezy start to the day. barometric pressure on the rise now. here is a look at the satellite radar. now we have the rain showers. some of you are still seeing rain off to east but this has been tracking to the north and east throughout the course of the last 12 hours really. so it is moving out of here. we are left with some clouds. we're left with some rain in eastern maryland and southern maryland, places like that. but it is pushing out during the next couple of hours. here is a look at the whole system and that is your cold front. that's causing the rain, the wind and the cooler temperatures that are going to be with us for the next couple of days. here is your five-day forecast. high today 61 degrees. i think that the weekend will be nice. saturday, a lot of sunshine and 65. that's not bad. that's where we should be for this time of year. sunday we'll add 9 degrees to that. how about that, that will warm you up a little bit but not crazy like in the 90s. things look good for the next

new this morning, a u.s. air force tilt rotear aircraft crashed in the southeastern province of kabul, killing three service members and one government contractor. the cause of the crash is under investigation. a taliban commander claims his forces shot it down.

the cv-22 aircraft takes off and lands as a helicopter but it's engines roll forward in flight allowing it to fly faster than a standard helicopter. thousands of people are gathering to mourn the victims of this week's revolt in the central asian nation of kyrgyzstan. new unrest broke out overnight. police killed 75 anti- government demonstrators who demanded the country's president step down. an opposition coalition has formed new interim government and will rule until elections are held in six months. a former producer for the cbs show survivor now being investigated in connection with his wife's death. bruce ber es-ford red man was arrested. mexican officials say he's been released but is not allowed to leave the country. sources say they saw the couple

police say they are making progress in their investigation into two separate shootings in howard county. the shootings happened earlier this week, minutes apart and a mile away from each other in laurel. two people facing charges in connection with the shootings. in one case a man is charged with setting up a meeting that turned into a robbery and a

woman is charged with being accessory after the fact to attempted murder. a 14-year-old boy has been charged with 41 counts for last week's drive-by shooting in southeast. four people were killed. the teenager faces four charges of murder, attempted murder. he was also driving and he's also charged with reckless driving and driving without a permit. six men behind bar this is morning in connection with two home invasion robberies in fairfax county. both times the suspects are accused of barging in on card games. the investigation started when four men were detained in rockville for a traffic violation and drug charges. officers were then able to link them to a home invasion in birk last month. and the other suspects had masks and guns but they took cash, credit cards and jewelry. they are connected to a similar home invasion in centreville ten days earlier. some of the victims were at both of the robberies.

7:30 right now. we really change gears and getting to weather for this friday and the weekend. >> sure do. i think it will be a decent weekend. we will have cooler temperatures but i think most folks will enjoy the weather we're going to have. let me show you the temperature trend graphic. you remember earlier in the week we had temperatures in the 90s. we set records of some of the area airports. well we're done with that now. today we expect our high to only be in the low 60s. about 61 degrees. but tomorrow mid-60s which is really where we should be for this time of year. sunday we're up again, 74 degrees. and monday a high near 70. not a bad weekend but not as hot as it has been. temperatures around the region, and we take a look in the district now. we're at 50 degrees. many of you are in the 40s. 46 in gaithersburg, 46 in frederick. 50 in quantityic off. annapolis at 53 degrees. a cooler start to the day and it will be a cooler day. i think you'll really feel it

tonight when the temperatures will drop off fairly significantly. satellite composite, we have had the rain shower that's came through and pretty good thunderstorms come through and that is tracking to the north and east. we still see rain activity and showers across central portions of the chesapeake bay and eastern portions of maryland. you're continuing to deal with rain showers but we are not seeing the thunderstorm activity any more. there is whole system. this is a cold front and it has come through. behind the front much colder air. out to the west in ohio, indiana, illinois, temperatures are in the 30s out there. here is your forecast for us for today. early clouds, give way to afternoon sunshine and breezy. much cooler and 61 degrees for your high today. those winds out of the northwest, 10-15, up to 20 miles per hour this morning and gusting higher than that. then for tonight, this is going to be part of the story where you don't think you'll like it. partly cloudy and cool to cold overnight. in town low to 42 and some in

and slow again north capitol street to third street tunnel. no problems from springfield to duke street but a brief delay across the 14th street bridge. that's a check of your fox 5 on- time traffic. he joked about terrorism, sent fighter jets scrambling but will not face any charges. mohammed al mod audi tried to smoke in the bathroom and then made a sarcastic joke about trying to set his shoes on fire. but he dodged the charges because of diplomatic immunity. joining us to talk about the law protecting diplomats, jacob frankel. is there anything because of the diplomatic ip community that he held? >> because of his position in the qatar embassy, the answer is no. what really happened here with the qatar government bringing

him home quickly, that was the easiest way to take a situation, particularly when you're talking about a country that is a partner in america's fight against terrorism, who acted much more out of arrogance and stupidity than anything else and basically said, we cannot let this public relations disaster fester. again, bottom line, took him home and that was the ultimate outcome. best the u.s. could have done had it been a different government is to say no, we're going to keep him here. the u.s. could have declared him persona nongreata and kept him here. >> and there will be no request for restitution. but as a former federal prosecutor, a couple of things stand out here. one, the gentleman who is -- caused this is gone. the other passengers who were on the plane, they were delayed

for hours. the one person said we got home at 2:00, 3:00 in the morning after they had to search our luggage. they scrambledf-16s at a huge cost and the cost to taxpayers somewhere between $50 to $100,000. is it maddening as a prosecutor to not be able to do anything about this. >> your darn right it is. as a prosecutor when someone breaks the law, particularly in this case almost flaunts the law and using arrogance as opposed to exhibiting humility, you want to bring the charge and set an example in a case like this and we're a diplomatic -- when that diplomatic immunity sets in, it's frustrating. and yet somehow that same level of immunity that protects foreign diplomats in the united states also protects american diplomats who are overseas. >> and that's why there is

hesitancy to make changes and also protects our folks in other countries. granted the laws were set 50 years ago. we didn't deal with terrorism back then. is it time for a change? >> there is always an opportunity to revisit the laws. you're right. it was 1961 when the actual treaty was created that sort of globally governors this notion of diplomatic immunity and we were not thinking about terrorism and many other offenses back then. but at the same time, that's one of the reasons that americans train their diplomats so well in terms of how to conduct themselves and other governments may or may not. and often when people are pushed to the point of reaction and confronted by law enforcement, as we just saw in this incident, they will do stupid things. but at the end of the day it's the responsibility of the home government to react. and interestingly, when you start talking about this notion

of diplomatic immunity and the role of diplomacy, i as a prosecutor always wanted to be able to conduct an investigation within the u.s. embassy overseas because if i could bring somebody else into the embassy to testify in an investigation, then they were on u.s. property. i could then use that much more effectively here in the united states. so there are a lot of issues that come into place where it might make sense to protect conduct, it won't happen. >> and i have to ask another question and with a condensed answer, and if i would have done that, if i would have smoked or made a joke about a bomb threat on a plane, i would have been charged and facing hefty penalties. just because this is a diplomat, does this in any way set any precedent against prosecuting the next person if they try to do this if they

don't have diplomatic immunity? >> not at all. anybody without diplomatic immunity, there would have been a case out there. it would have been united states versus that person's name. a half a million dollars in rolex watches stolen in broad daylight. wait until you see how the thieves disguised themselves. and plus the salahis first big social appearance since the state dinner back in november. they were invited, but wait until you hear who was kicked out. fox 5 morning news continues after the break. ♪

a jewelry store heist caught on tape in florida. last month three men went in a wheelchair and another disguised as a woman walked into the store in coral gables. the man in a wheelchair jumped

up and sprayed mace at a security and the three smashed the glass cases and made off with half a million dollars in rolex watches. police hope someone will recognize the suspects from this video. who could forget the white house party crashers. the salahys. they were invited guests at a party in adams morgan. >> but the problem was a paper was not. even though they went ahead and purchased tickets online but they were still kicked out and they got the boot as the salahis were making their way inside and they did manage to snap a photo of the couple walking in. >> what is that about? >> getting a picture in the paper. >> the other thing that was interesting is the reliable

many hard and even some who have kept up with their mortgages. one couple found out their home had been sold without their knowledge or consent. it had mistakenly being placed on a foreclosure list. julia harding has more. >> reporter: two days ago, this family felt like the rug had been pulled out from their them. their house was sold and it was not even on the market. >> on tuesday my husband was outside working on his truck and a guy came over to him and i think shook his hand and said hi, i just bought this house. so he's thinking, yeah, right you're joking. so he rang the door bell and my husband says, this guy is the new owner of this house. >> reporter: unbeknownst to them, their home was auctioned off at the jackson county courthouse. their house worth half a million dollars had made it to a foreclosure list.

getting together to talk about nuclear events then security will be tight. sherry ly has more this morning about what to expect. >> reporter: well it is no picnic getting around town on a formal work day and now add in the world leaders coming here for the nuclear summit. it could be worse than it was during president barack obama's inauguration. you can see right over here they have all of these barricades ready to go to close off some of the streets around here for dozens of blocks around the d.c. convention center. roads from k. street to q street will be closed and that includes major commuter roads among massachusetts and mount vernon metro stop will close at 9:00 p.m. on sunday and bus lines rerouted. the secret service will take over the convention center sunday evening and begin securing the area and anyone trying to get into the secured perimeter will have to show

identification that they live here or work here. and one of the things to consider, this is something that affects not just this area but around town. you have the 40 world leaders coming from embassies and hotels and they all need to get here and that means motorcades so traffic delays all over town. officials are urging federal workers to take leave if they can on monday and tuesday when the summit is here or work from home or at an alternate location to avoid being downtown. live at the convention center. sherry ly, fox 5 news. back to you. the roads not the only thing being impacted. the mount vernon square metro stop will be closed and streets around the convention center will also be shut down. everything from k. street to q between 7th and 10th streets. parking at a minimum and bus routes alter, all starting sunday night. a fare hike or drop in

had to come back out of the mine. now hopes diminishing. craig bosswell joins us. some disappointment pod. >> reporter: major disappointment. and that long and difficult night is pushing into today. they had to evacuate the rescue teams from the mine here. the other part of that disappointing news, they got to one of the refuge chambers where they thought the miners could be located and there was no one there. they were headed up to the other refuge chamber, the other last resort place where the miners could be located and encounter smoke. an unexpected fire and they did not get there. this morning, about an hour and a half ago, the governor and kevin strickland with msha brought us up to date on the fire and what is going to be happening next. here is what they had to say. >> the thing that is unknown is

exactly where this fire is at. we don't know if it's from the head gate 22 area or from the in by area toward hole three. and it's a very tough decision, it was to pull the rescue teams out and not put them in harm's way based on that smoke that we saw. >> reporter: tension continues to rise. the frustration is continuing here. instead of sending crews back in, which they cannot do because of the fire, they'll folks on drilling holes. they're going to continue to drill holes down near the area and put a camera down in that area near where the last refuge center is and see if the miners might be inside. keep in mind, it's 1100 feet down they have to drill. they've already drilled feet so there is a long distance yet to go. again, another frustrating and agonizing day for the families of the missing miners to try to determine if they are still alive. and steve, they are clinging to

[ horn honking ] >> reporter: the 14th and u. street corridor is one of the hottest areas in the city and filled with new restaurants and bars. but no more. this ruling by d.c. r.a. said the area has reached its

capacity and no more permits will be issued for restaurants, diners, bars or carryouts. it's started an uproar. >> i don't favor complete ineligible for any kind of additions and that's what i fear we have at the present time. the door has slammed shut on any businesses -- new businesses at all. and so it's about striking the right balance. >> reporter: the mid city business association is slamming the decision, calling it outdated and harmful. business leaders also say it discourages entrepreneurs and sends the message that d.c. is not business friendly. some residents say the area is big enough for everyone. >> i was thinking in this area, people want to come in and put restaurants and businesses in. there is no reason they shouldn't be able to come in and put places in. it's a great area and it's up and coming and there's to reason to slow that down. >> reporter: over the last five

8:27 right now as we take a look at stories making headline this is friday morning. a u.s. air force tilt rotear aircraft crashed today in afghanistan killing three service members and one government contractors. the cause of the crash is still under investigation. a taliban commander claims his forces shot that aircraft down. al-qaeda is claiming responsibility for a deadly triple suicide bombing in bagdad. for man 40 people were killed in the attack outside of foreign embassies. they called it a new strike into the heart of a security plan in bagdad. amnesty international accusing the u.s. government and gulf coast states of consistently violating the human rights of hurricane victims since hurricane katrina. the the group says the

these fade off to the east very quickly. it's all pushing off necessity -- off now very quickly. and winds out of the north and west and so it will be cool but at least we get rid of the rain and cloud cover here. there is the rain extending from the carolinas up through southern new england. and once we get it out of here, look at what is happening to the we have. not much of anything. high pressure will build in and should be a great couple of days around here. in fact the next several days should be just fine with a lot of sunshine and blue sky out there and low humidity with temperatures a little closer to where they should be. our average daytime high is in the mid-60s, i think 64 and closer to that number over the next couple of days. 54 at reagan national. 46 in gaithersburg. look at the 40s. 49 in dulles. 48 in winchester. so much cooler air today. our high temperatures will only be in the low 60s and you can mix in the winds which are gusting out of the north and northwest at about 24 miles per hour and i think some of us

medical emergency while behind the wheel. the 65-year-old man's injuries were said to be life- threatening. no one else was hurt. montgomery county is changing the way you pay for parking. you can now do it using your cell phone. just sign up online, dial the number on the meter and then follow the prompts. the county has decided to expand a pilot program in bethesda across the country. the pay-by-cell-phone program will cost you an extra 25 cents every time you use it. right now it's only offered in bethesda but it will go county- wide next year. and this le send you a text when you're meter is about to expire. and metro's board has given preliminary approval to allow users to check your card status and make any changes and will save metro some money. the program should start in july. want to take a couple of seconds to thank the students and staff at mary church
